1. About the Service

WhoIsRight (whoisright.org) is an AI-powered debate analysis platform operated by FOP Yevhen Borzenkov (sole proprietor registered in Ukraine). The service uses multiple AI models to provide unbiased analysis of debates and disagreements.

By using this service, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the service.

2. Eligibility

You must be at least 16 years old to use this service. By making a purchase, you represent that you are at least 18 years old or have the consent of a parent or legal guardian. You must not be located in a country subject to international sanctions that would prohibit use of this service.

AI analysis is provided for informational and entertainment purposes only. Results are generated by third-party AI models (accessed via OpenRouter) and:

We do not control the output of third-party AI models and are not responsible for their accuracy, quality, availability, or performance. You must independently verify any information obtained through the service.

5. Points and Payment

To use the service, you need points. Points can be acquired in two ways:

All prices are in US dollars. The actual charge on your card may differ slightly due to currency conversion by your bank.

6. Legal Nature of Points

Points are not legal tender, currency, or stored value. Points represent a limited, non-exclusive, non-transferable license to access AI computing resources through our platform.

7. Points Expiration

Unused points expire 12 months after the date of purchase. We may, at our sole discretion, extend the expiration period. We will make reasonable efforts to notify you before your points expire (via the email associated with your Google account), but failure to notify does not extend the expiration date.

8. Delivery of Service

Upon successful payment, we immediately provision an API key with the corresponding credit limit on OpenRouter and link it to your Google account. Delivery is considered complete when:

9. Right of Withdrawal

By completing a purchase, you expressly consent to the immediate delivery of digital content (points) and acknowledge that you lose the right to withdraw from the purchase once points are delivered to your account, in accordance with applicable consumer protection laws.

10. Account and Authentication

Purchasing points requires signing in with a Google account. Your points and purchase history are linked to your Google account and synchronized across all devices where you sign in. You are responsible for maintaining the security of your Google account. We are not liable for unauthorized access to your account.

An analysis may not reach completion due to circumstances beyond our control, including but not limited to:

Points are consumed incrementally as each AI model call is made during the analysis. If an analysis is interrupted before completion, points already spent on completed model calls are not refunded, as those AI computing resources have already been consumed. You may start a new analysis to try again.

14. Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the service.

Our total aggregate liability to you for all claims arising from or related to the service shall not exceed the amount you have paid for unused points in the 12 months preceding the claim.

You agree to defend, indemnify, and hold harmless FOP Yevhen Borzenkov, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with:

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, cyberattacks, epidemics, government actions or regulations, power or internet outages, third-party service provider failures, or supply chain disruptions.

17. Modification and Discontinuation of Service

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, including but not limited to available AI models, pricing, point values, and features. We will make reasonable efforts to provide 30 days' notice for material changes. Continued use of the service after changes constitutes acceptance.

If we permanently discontinue the service, we will make reasonable efforts to provide a refund for unused, non-expired points.

18. Intellectual Property

You retain ownership of the questions and arguments you submit. AI-generated analysis results are provided for your use without restrictions. The WhoIsRight platform, brand, and code remain our intellectual property.

Any feedback, suggestions, or ideas you provide about the service may be used by us freely without any obligation or compensation to you.

19. Account Inactivity

We reserve the right to delete accounts that have been inactive for more than 24 months. We will make reasonable efforts to notify you at your Google account email before deletion. Points on deleted accounts are forfeited.

20. Changes to Terms

We may update these Terms at any time. For material changes, we will make reasonable efforts to notify users via email or a prominent notice on the website at least 30 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance. If you disagree with the changes, you must stop using the service.

21. Dispute Resolution

Before filing any formal claim, you agree to first contact us at evgeny.borzenkov@gmail.com and attempt to resolve the dispute informally for at least 30 days. Any claims arising from or related to these Terms or the service must be brought within 12 months after the cause of action arises, or they are permanently barred.

22. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine. Any disputes that cannot be resolved informally shall be submitted to the courts of Ukraine.
